Did not someone once observe that there are in fact only thirteen notes including the octave? Is this a case of one is making money and the other ain't? Sad?

The good news is that if the music business continues on its current trajectory, in a few years nothing will be making any money, and the lawyers will abandon this kind of lawsuit altogether. You do not ever hear of an infringement lawsuit involving published poetry. That genre went to the pay-to-publish-your-own-chapbook model in the day of Robert Frost.

It all started when Frank Zappa found the first new chord (fish minor) since 1796 and copyrighted it. No one has used it since. Ever notice the blatant similarities between "Great Balls o' Fire" and "Johnny B. Goode"?. I wonder why there were no lawsuits over those songs.

you had me curious about this. I had never heard of Zappa's "Fish minor" except from you, so I googled it and the only reference to Zappa and "fish minor" at the same time is this thread! It was a comment by Mr. Z at a MoI concert I attended in Munich, Germany in 1970 or 1971. Strange that the moment has never been documented on the internet until now.

Its funny, but RIAA considers all new music to be derivative of something they already own a copyright for. I guess they are saying there can be no more original music.

Is it not true that any two chords in a sequence have been used a gazzilion times and that any three chords in a sequence have been used a bazillion times etc. Same goes for melody I assume too. All my future songs witll use the C, Am, F, G sequence. Sew Sue Mee.
