A Lot of Deaths (R.I.P.s) Here ... Xmas Tornado's Spared Northern Alabama
'Interesting how Xmas seems 'just another cursed day of death and destruction', 'out there'. Albeit, its been another pretty destructive year around me. (Ambulances are roaring outside now) My next door neighbor just sued me for a Gazebo I built that blocks his lake view. Hahahahaha! Ah, WWBCD, (what would Bing Crosby do)? Santa songs all year? I'm hoping those white-Xmas songs (over yonder) won't be hanging around much longer.

Sad to hear about the tornadoes. RIP to the victims.. Best wishes to the survivors. Good luck with the weather and the legal system.

I know you've been through a lot recently Philip. I can't even imagine how rough this Christmas must have been. As for the Gazebo .... if you live near a lake, or in one of those lake communities, your neighbor is probably going to win and you'll have to move or tear down the Gazebo. It's just one of those things. Yeah, it's 'technically' your plot of land, but you share the lake with your other neighbors ... I'm concerned that my neighbor is going to be upset about the building we just built on our property. It blocks the view of the woods and our pond from him. I told my wife I wanted to go ask him if he had any concerns with us putting it there, but she said I was being crazy ... time will tell ... The county made me put my lateral lines for my septic system on top of the ground and cover them with 18" of dirt when we built our place up in Iowa. They did it because the water table was high. There was a hog confinement across the street ... 2,000 + hogs ... 300 feet from my laterals with their runoff running in the ditch and going down grade in front of my house and my neighbors house. My neighbor lived 1/8 of a mile away. He threatened to sue me because he said when the wind was out of the West, he could smell my 'sewage'. Never mind the 2,000 + hogs that created a constant haze of steaming stench with their runoff going in the ditch washing away in front of both of our houses ... my septic tank was the problem. This is the same guy that attacked me for putting up a fence, on my property, that he didn't like. Woven wire cattle fence, couldn't even see it from 20 feet away, it blended in with the surroundings and was basically invisible. People suck man. I hope it all works out for you ok.

Sadly your respectful intentions could be construed by a lawyer as some kind of admission of wrongdoing so if your neighbor tries to get litigious he might be able to use it against you. I'd say just not worry about it and don't bring it up. If you followed the local building codes then you should be good. Sucks having to view the world that way but darned if people don't try to screw each other mercilessly. Cheers.

Thanks for chiming Old55, Beepster, Bub, and James. Its great to hear from you guys!!! Ah, what is "wiser" anyway? UFOs and 3 wise kings at a Bethlehem manger? TBH, I'm not very religious about either. (Oops, 'hope we didn't just violate the forum guidelines ... talking about wisdom, xmas, and all this religiosity; I scrupulously left out the "J" and "C" words. "Happy holidays" is now politically correct my motto.) Bub and Beepster, both my neighbors are lawyers ... so my getting a lawyer to fight against another (in one's county) is illegal. Defending myself would have to be "pro se" (representing self). I invited he and his Jezebel (his instigator) to Thanksgiving, but they didn't show. The lawyer used another lawyer to invoke His "declaratory suit" that is pre-court right now. The guy never met me face to face -- hahahahahah! What a loving neighbor! OTOH, I seriously do love my neighbor(s) (and I love you, sir James) and should require whats in my neighbor's best interest in my short life. But, if he wants to continue to use legal attacks to be my loving neighbor, that seems pretty self-destructive, imho. I dunno. I hope and pray we all work it out, as loving neighbors. What do you all think? I'm petty certain you'd all concur.
