SD3 step sequencer problems

I am currently experiencing a number of problems with the step sequencer in X1
I have been running x1 for a while (since it came out) and have had few problems until now.

I am trying to create a simple shuffle pattern - something I have done a few times before but experience the following problems

I create the initial clip as follows 4 beats 4 steps fit to 8ths - works fine.
I then copy this clip to 2 new layers and clear out the beats from the last 2 steps of the first copy and the beats from the first 2 steps of the second copy.

a couple of strange things happen now:
1 - when I add new beats (for a drum fill) the velocity controls for the beats are gone and I see the pencil but no velocity bars
2 - when auditioning the clip in step sequencer the "fit to " value reverts to the default 4 which obviously speeds the clip up significantly. Now some people might say that this is an accurate reflection of a real drummer (they all speed up don't they?)

but seriously has anyone else come across these problems?

BTW i have the latest quickfix applied.
