I have a first generation Yamaha 01v that I've been using in my home studio that's starting to age out.  Besides a channel that's died and various buttons that are starting to not make contact the way they should...there's the issue of AD/DA converters that are very much old school.  I'd like better converters and pre-amps, but I still like the idea of a mixer in the studio for zero latency monitor foldbacks with "confidence" fx's for the talent.
 
I've been looking at the newer generation of live mixers, but most of them now have a fixed sampling frequency.  I'd like the option of using 88.1 or 96 kHz.  (I don't see much use in going any higher than that.)  But I do want something that'll give me closer to 24 bits of actual headroom.
 
The only thing I've seen that will fit in my rack (oh yeah...it really needs to be rack mountable) is Yamaha's 01v96i, which happens to be selling at B&H for $1,500!  That's probably because even the new version is freakishly old in the tooth.
 
Is there something else out there that's more up to date that would fill this bill?

It won't go above 48k... but the fidelity is good.
 
If you can live with tablet-based (touch) control, you've got a lot more options.
The new MOTU AVB series would be worth a look.
Noise-floor on the bigger ($1500) units is ~-117dB.

I have the same situation and actually came to the same conclusion that the newer version was the best replacement. I'm not sure why your worried about the converters and the clock rate. If that is a concern then you will have to spend $5,000. It's a diminishing return. You then have a small small improvement in fidelity. 
I'm of the camp that these higher sample rates are sort of a fad and that 48 is still a very workable place to be. I actually do most work at 44.1 because it's about on par with the rest of my gear. 
 
If I upgrade to the new 01v,  I can use my expansion card still. 
And I won't have to re learn a system. Mine is 20 years old and still 98% functional. Not sure if the newer Yamaha stuff is as well built but it make me think twice about replacing it with a Behringer X air or a Q mix. 
If money was no object I'd be looking at digco or midas or maybe the high end Yamaha's. 
 
Just go to each major manufacturers web sites and see whats new in digital offerings. Gear sluts is a good place to look for conflicting comments too.

I've considered the M32R.  But, it's a little bigger than the rack space I have available.  There are rumors that it will eventually support higher sample rates...but I'd rather see that in the flesh than to buy into it and hope that they will deliver in the future.  Actually, at one point it made a lot of sense, since the live board I was working with was a Behringer X32 (which the M32R is essentially a re-skinned version of).  The downside there was the unreliability of the AES50 connection to the digital snake.  As I understand, the only real difference between the X32 and Midas version are the faders and pre-amps.  So...it would inherit the same flakey transceivers that the X32 has.

I used a X32 Compact for about a year.
The onboard USB/Firewire audio interface didn't offer low enough round-trip latency...
Wound up using a Lynx AES-16e-50 (AES-50 port - 32 channels of I/O via single CAT-5 cable).
I didn't move the X32 (studio use only)... but the X32/Lynx combination was completely reliable.

I'm still mulling this over.  (I'm not sure that I would be so fazed by latency that I'd want to spend another $900 on the Lynx card.)
 
It's odd how "little" things can add up to be deal breakers.  For instance, the M32R's inputs are all on the back of the unit rather than on top (like the 01v variants).  This makes it unusable in the rack space I presently have for it.  Also, the inputs are (for the most part) all XLRs (no combo jacks or parallel 1/4" jacks), so I'd need something like a Radial ProD8 (at a hunerd bucks a channel) to handle 1/4" stuff.  There are a small handful of Aux inputs, but they lack a lot of the features that are on the standard inputs.
 
So...$1,500 vs ($3,000 + $800) = $3,800 plus a new place to put it...starts making it a harder sell.
