9.5.40 was released a couple of weeks ago. I didn’t jump, and good I didn’t as there were some bugs according to the forums. Supposedly a quick fix is coming out soon. So I would advise to just wait a week or two. Unless you have an urge to be a beta tester.

I upgraded and haven't really noticed anything bad but it didn't improve/change anything either, which is why I didn't bother even saying anything here about it.  Does look like there are a few issues though.  Given how little this release gives you skipping it would be for the best.  The three issues they saying they will fix are:
 
1) Crash while record in some special cases.
2) MediaBay preview out of sync and not possible to go thru the list while playback in Cycle and Align to Beats is enabled.
3) Channel Strip Presets cannot be loaded.
