Shameless Self Promotion

This is the third video I created using clips downloaded from different sites, and set to music written and performed by Ric Laue. I actually tried some video editing tricks in it, with scenes superimposed and changing pictures/clips as close as possible to the music.
This one has a story line of Captain Jack, a modoc Indian who was basically chased into a lava bed area in the northern california high country. The first pictures are of him and his family, and the area called Captain Jack's Stronghold, where he and a band of approximately thirty men and women held off the U.S. army for weeks, but, he was captured and hung, with two others, for their "crime" of defending their freedom.
The middle is a video of native dance, and the last part is from a TNT mini series called In The West that aired in 2005. The words are from Captain Jack's great grandson.

    I enjoyed the video.

    It is almost always considered a crime when anyone tries to defend their freedom, unless the ones defending it are victorious. Then they write history as they wish.

    I believe it is a statement from ancient greek or roman times, that history is written by the victors. In researching this video, I learned a lot about the Modoc indians, and their plight. They were forcibly moved from a reservation in the middle of the country, land needed for farming and development, to a reservation inhabited by their tribal enemies. The battle they fought with the U.S. army was the costliest for the government to date, both in money and lives lost.

    Cool song.

    The mix is rather bad though. I know youtube is not great for quality but there were times when it was just really boomy. The mid range lacked presence and there was no depth. Was this done in Cakewalk?

    As a person who likes to write, draw, make music and produce videos myself, I must state for the record that I do not have a great deal of respect for people who use samples (videos, images, text or music) of other peoples work unless they credit that work within the film or song. Its called plagiarism otherwise.

    The sound quality is very poor, my only assumption is that that is a by-product of the compression process, as the original sounds almost nothing like the video. But I am not going to remix the audio to optimize every compression program out there.
    As far as the sampling comment, might I ask for suggestions? Sampling is done throughout the music industry today, in fact, some music is totally devoid of original content, and still getting airplay. I'm not sure of your budget, but in order to produce a video with half of the content I tried to present, I would have to have the backing of a medium to large studio, which would stop me from even trying. As far as plagiarism, the original clips used were downloaded from sites similar to youtube, and then heavily edited, and, should the time come to publish this or any other work arise, full copyrights would be applied for. But, as it stands, I believe, after researching (and before posting), that this work falls under the "fair use" doctines, but I am not a lawyer, so it is only my interpretation of the law as written.

    That is an accusation.
    If your point is to suggest providing credit for copyrighted material, there are better ways to express yourself.
    But, I would rather get beyond that stuff, and just take your suggestions in the best of humors. I tried to get a better mix quality posted, but there is nothing I can do with it. I'm starting at 44.1kz, 16bit, but nothing seems to work for improving the sound after compression.

    According to the U.S. copyright office, and the European Union has adopted similar codes in order to create parity:

    In a 1994 case, the Supreme Court emphasized this first factor as being a primary indicator of fair use. At issue is whether the material has been used to help create something new, or merely copied verbatim into another work. When taking portions of copyrighted work, ask yourself the following questions:
    Has the material you have taken from the original work been transformed by adding new expression or meaning?
    Was value added to the original by creating new information, new aesthetics, new insights and understandings?

    If, in the future, this or any other copyrighted material would be used for something presented for sale, a mechanics license would be applied for, and credit would be given. And for the record, I did credit the original in the notes that accompanied the video, but you are right, that credit should be in the body of the work.
