(CNN) -- A Comic-Con attendee stabbed another near the eye with a pen Saturday after they got into an argument over whether one was sitting too close to the other, police said. The injured man, in his 20s, was taken to a hospital with a minor cut, said San Diego Police Officer David Stafford. The attacker, also in his 20s, was arrested and booked for assault with a deadly weapon, he said. No wonder texting is becoming so popular and seeing people in public meetings with loaded guns is becoming second nature.

Any object that is used in an attack becomes a weapon, even if it was not made with the purpose
of causing harm.
To be clear, a pen is not built with the purpose of causing harm, but if I choose to stab someone with it,
it then becomes a weapon. Because I could stab someone in the heart, for example, it could cause the death
of that person, hence it is a deadly weapon.

I always carry a pen, but I'm highly trained on it's use.
It's there if needed but not on open display, the ink stains on my shirt ought to be deterrent enough.
Mostly though I'll go for a 2b pencil to get my message across clearly without causing lasting damage.

The issue is the type of assault, not the type of weapon. If I hit you with a pillow on the buttocks, there is no expectation of serious injury. It is a simple assault and battery. If I strike your head with a baseball bat, strangle you with a dog leash or stab you in the eye with a pen, there is clearly an attempt to inflict serious, potentially deadly injury. In that case assault with a deadly weapon is appropriate, and more easily proven than attempted murder.

My money says that while someone was dialing 911 on their cell phone to report the incident, there were a dozen other people using their cells to capture video or photos and another 2 dozen 'Tweeting' about the incident. Damn... when did I become so cynical?

Why anyone would be sitting in a crowded room waiting for actor Seth Rogen is beyond me.
