Last time I wore spandex I had an official 'take down' request.

Fortunately, I couldn't comply as it was far too tight.

I also fail to see the connection between copyright infringement, and homeland security.... just saying..... what is the jurisdictional authority they claim there to seize private property in this manner?

It's just the government subdivision that enforces the relevant statutes. From http://en.wikipedia.org/wiki/Immigration_and_Customs_Enforcement
Homeland Security Investigations (HSI)
ICE headquarters building in Washington, D.C.
The Special Agents of HSI use their broad legal authority to investigate and combat a range of issues that threaten the national security of the United States such as strategic crimes, human rights violations, human smuggling, art theft, human trafficking, drug trafficking, arms trafficking and other types of smuggling (including weapons of mass destruction), immigration crimes, gang investigations; financial crimes including money laundering, bulk cash smuggling and financial fraud; terrorism, computer crimes, Intellectual Property Rights crimes (trafficking of counterfeit trademark protected merchandise), Cultural Property crimes (theft and smuggling of antiquities and art), and import/export enforcement issues. HSI special agents also conduct investigations aimed at protecting critical infrastructure industries that are vulnerable to sabotage, attack or exploitation.[13]
HSI was formerly known as the Office of Investigations (OI). HSI Special Agents have legal authority to enforce immigration, customs, along with Title 18, 22, 31, and 21 statutes; giving them very broad federal jurisdiction. HSI has more than 7,000 Special Agents, making it the second largest federal investigative agency within the United States government next to the FBI.

....................

Cyber Crimes Section

The Cyber Crimes Section (CCS) is responsible for developing and coordinating investigations of Immigration and Customs violations where the Internet is used to facilitate the criminal act. The CCS investigative responsibilities include fraud, theft of intellectual property rights, money laundering, identity and benefit fraud, the sale and distribution of narcotics and other controlled substances, illegal arms trafficking and the illegal export of strategic/controlled commodities and the smuggling and sale of other prohibited items such as art and cultural property.

And I do not believe (I might be wrong) but my understanding is this has not yet been passed into law....and to my understanding, they have to have a law that allows this sort of police state action, to be  properly passed and signed BEFORE they can seize something..... and due process, you know the innocent until proven guilty thing kinda comes into play as well, they have to prove you guilty in a court of law, or convince a judge to sign a search/seizure warrant......... so they are overstepping their authority by law.... then again, this might have had some sort of national eminent security threat that clearly supersedes the constitutional bounds, but I always thought the constitution was specifically written to prevent government abuses like this......  I don't know..... just saying.

There might be some unknown national security threat that we are not aware of that selling a fake handbag or allowing an illegal music download will cause.

They had warrants and didn't seize anything without warrants.

This site contains no copyrighted material, in fact it doesn't even contain comment, and yet I'm sure there are some folk that would like to see this one seized and redirected just now.

It's quite possible that some of those pirate sites finance terrorism. Why not? They've attacked us every other way they could.

Well, I'm having decaf myself...... mighty fine too.

So.............................. I don't care....... I said it in a song..... and as long as they leave my site alone I'm cool with that.

Any additional commentary on my part would likely cross the TOS line and get me in trouble with the mods..... so.....

on another topic.... hey, it's my thread and I can hijack it if I wants to.....

I just finished up a really cool song.... it's totally different than the normal style I generally do.....out of the box as they say....... totally orchestral in nature.... no rhythm section in this baby at all.....  the only drums are timpani.... it also includes cello, french horn, trumpet, piano and guitar.  Very classical in nature...... totally gorgeous. I can't post it yet since it is a collab and the other half of the collab has not yet replied back....... and likely he will post it on his site.

Why don't the feds shutdown these ****s that take control of your machine and pretend to have the "fix" if you buy their antivirus software?

Yeah, +1 for me on that one, Mark.  Visiting friends in Las Vegas, I got to spend a frustrating hour or 2 purging a few of those suckers off one friend's pc.  It didn't go peacefully, but it went.

Re:Web sights seized and shut down... 2010/11/29 16:43:34 (permalink)
Hi,

I'm not really surprised ... however, I do think that in the long run this is going to hurt the music business a lot more than otherwise ... why do I say that?

In the end, there were a lot of bands that made it big because the bootlegs showed that the bands were excellent in concert ... Led Zeppelin was one such example ... after the first 3 bootlegs, there wasn't a single LZ concert taht wasn't sold out. Pink Floyd ... trippy stuff in the early days, that got people wanting to come for the trip. Grateful Dead with their really long all night jams that you couldn't even put on the LP's! Bob Dylan with his knack for switching the words in his work and come up with something totally else ... the list is endless.

There is a lot in Torrent that is stupid and should be taken down ... but because of their own greed factor, they hurt the whole thing ... I mean ... what is the point for half that porn when it is all available on the Iner for free in streaming versions? What is the point of having all those Harry Potter movies when you can get all of them in the store?

In the end, their low key approach was no longer a low key approach, and it will attract the wrong people to it, including some greedy fascists out there. And these folks do not have the artists' interest in mind, as much as they say they do!

Somewhere along the line, congress and the law are going to have to distinguish something about the copyrights ... when there is no money involved it is no different than me lending you a book so you can check it out ... there is no copyright violation. However, they might not like the public distribution thing ... which is a valid point ... but again ... if I gave it away ... what's the problem?

The thing is ... and it was visible in those bootlegs ... that some bands were actually allowing them to be around so it would help people meet the band ... and like that one metalcrap band, one day they changed their mind ... and didn't need it anymore and stopped it and went after all the old stuff!

In the end, using the law like that to make a point is not a good thing ... the guy was doing that as a labor of love, not a money making venture as some other sites had done before ... and as such ... but getting copies of Avatar three weeks before it's released ... is not only STUPID ... it's bizarre ... and asking for trouble ... specially when that studio has over a billion duckets to play with!

As a wise Guy once stated from his holy chapala ... none of the hits, none of the time ... prevents you from becoming just another turkey in the middle of all the other turkeys!

Re:Web sights seized and shut down... 2010/11/29 18:57:19 (permalink)
Hi,

One other really sad thing ... it's called HISTORY!

Example:

Pink Floyd ... the bootlegs showed the connection between Pink Floyd and the arts ... it also showed that they used sound effects as breaks between songs so they could program their instruments and effects properly. And this led to creating a couple pieces of music around the sound effects one of which is one of the most famous albums of all time. And later, helped define the work of Roger Waters, who does this even better in the album "Amused to Death".

It also explains Syd Barrett way better than all literature ... Syd WENT to the Dark Side of the Moon and no one could see him, or talk to him ... and the original Greatest Gig in the Sky was a bunch of priests sermonizing on top of each other with Syd Barret on top and closing it with "... people have stood, and cheered, something they did not understand" ...

During that tour, they were playing "Raving and Drooling" and "Gotta Be Crazy" ... and the record company declined these two pieces altogether and forced them to create something that was closer to DSOTM ... the result was "Wish You Were Here" ... that only has 2 things that are important ... 1 is "Welcome to the Machine" which is a big finger to the record company and how nice it is to be a part of the machine ... and you missed the English humor and cynical feeling along the way ... they were happy to be there, but not happy they had to be told what to do! ... and 2. Have a Cigar, where Roy Harper gets to use his cynical style in English humor ... it's ok ... have a cigar ... you're rich now ... which is just like a record company executive telling PF that they are famous now, can smoke a cigar and ... just have fun ... the rest is nt important in the album at all!

Other bits that are important ... "Tonite We All Love in London" ... which was a huge event that had all kinds of rock stars and movie stars and art stars not to mention a lot of literary stars some of whom read poetry ... it all meant nothing, of course, to many idiots that don't think that musicians are not intelligent, and sometimes even, educated and know what they are doing. On top of it, it is the same show where The Soft Machine played and Robert Wyatt gor fed up with the snobbishness of many rich farts walking around ... and broke into the famous ABC ... which threw a lot of the jazz folks into a spin! ... And in the film you only see Syd Barrett doing his thing on "Interstellar Overdrive" ... and the rest is ignored, and a lot of fools like us think that it is "progressive" music of some kind!

It's hard ... but when you "erase" history ... all in the name of money and some interests ... I really question the value and intent and the evil-ness in it all. In the end, it is a total dis-service by greedy corporations that feel that the world owes them a red carpet and their fancy cars, and they do not give a cahoot about the music ... just the money

As a wise Guy once stated from his holy chapala ... none of the hits, none of the time ... prevents you from becoming just another turkey in the middle of all the other turkeys!
