Hi every one @Dok i'm going to try that 3.6 install again see if that helps also yeah i upgraded to 10 and i thought that might have been the issue along with a load of other bugs but reverted and still having same problem.

@Met no on board port just a pci express card. I'm thinking if there was an on board port i wouldn't even have this problem.

Win10 and VIA are not a recommended combination - "We have become aware of a connectivity issue running Saffire units on Windows 10 connected to firewire cards with a VIA chipset. We are currently investigating this issue as a top priority. In the meantime, if you are using a VIA chipset, we recommend you do not update to Windows 10."

Yup I can't use saffire Pro 40 on win 10 this reason. That's why I asked if you had attempted it earlier. Some are running in VIA but I would avoid unless you do dual boot or something.. Go through the checklist first I would.

So if everything else has failed would it be time to look for a texas instruments chipset card?

VIA works fine on win 7/8. It should work fine on 10 once issue is fixed. If all else fails try a new Win 7/8 install. It's a Focusrite recommended chipset.

.. and if that fails find a friend with a FireWire PC or Mac to test it on...

Yeah i think before changing or buying anything else thats the next step to try it on a firewire supported pc or mac. I may also go for a reinstall of windows. would i have to wipe everything or just try a different version (ihave windows 64 ultimate) should i try install windows 7 64 professional or home instead? (Assuming i had copies of these laying around at home)

Any version of 64 bit windows 7 will do. Do a clean install.. Best to backup and wipe. Or do dual boot on a new partition.
If it works you could then backup and then try windows 10 straight away (with a view you might need to restore from backup or roll back (restore from backup recommended)).
I recommend something like acronis trueimage and backing up to an external hard drive.
