Our petition to Microsoft to rescue Cakewalk out of Gibson!
 
Cakewalk and later Sonar has been our favorite DAW (Digital Audio Workstation) for many years. It is the home we go to when being creative. From writing songs, record songs, mixing songs to master songs and albums. We deeply love Cakewalk and Sonar.
 
Gibson is now stopping developing and service of Cakewalk and Sonar. So they are basically giving it up.
 
Dear Microsoft.
 
Please rescue Cakewalk and Sonar out of Gibson. You can make Sonar a system like Office and Office 365. And Music Creator to an app in the store. And please make it under insider, so that we, the users can have a say in the development. You can rebrand it if you want, but please make it backward compatible with current Sonar, Music Creator and pluggin base.

If Gibson goes belly up, who is going to enforce these rights? Or more importantly, who would care?



If Gibson goes through bankruptcy liquidation, then someone will probably buy up the patents and IP for Sonar and the rest of the Cakewalk products. Then they'll enforce their patents, even if they don't actually plan to make use of them in their own products. 
 
I could be wrong and someone nice buys the IP and plays nice by resuming development. But that seems unlikely once all the key developers have scattered to the corners of the development universe. Any bankruptcy liquidation isn't likely to happen for quite a while and all the developers still need to feed their families.

So if Gibson is going under or filing bankruptcy, the smart move is to keep the code until after the bankrupcy is complete  The re brand it.
Even if Gibson wanted to keep SPlat to market. the "lifetime updates" has to go!
So re branding is the solution!
 
Gibson could have sold the DAW and all other digits to another company that will release it as another DAW.
But in the position Gibson is in... they most likely would have kept it. 
 
It makes no scene to just let it die.  
 
On the 5th of oct. Right after Craig was let go, Gibson had a new ad up looking for a replacement.
along with a boat load of other jobs. They are selling their factory. yea, Nashville is booming development, the smart move was to sell and get a bit out of the city...
 
Edit. if you look at who is offering cross grades and who is not... you may find the answer to who may have the Splat code... PT?
 
So from this it is simple to see that Gibson is moving to cash in and retool... If CW is out then they sold the intellectual property. ie the digits "Code" without the CW brand. THE SMART MOVE.

^This is most likely what's going to happen.  They aren't going to get much for what's left of Cake, but they will have to pay off creditors, and they will use the sale of Cake IP in part to do that.

Copyrights has nothing to do with the business shelf life. I started a business and copyright lots of stuff. The business is no longer here but the materials are legally copyrighted to me.

You know what I'd do now if I was interested in buying Cake's technology?

Nothing.

Because whatever price I might get for it now I'm very likely to be able to get it for less in the possible, even likely, Gibson bankruptcy fire sale. Gibson guitars are likely to continue under a new ownership structure even if the current company is bankrupted. So are other bits of Gibson that make money or can be easily made to make money once detached from a parent company in severe financial and managerial difficulties.

Cakewalk, on the other hand, is unlikely to be worth more in six months than it is now and is probably going to be eventually sold at a rock-bottom price. The longer Sonar isn't available to buy the lower that price will be.

From a potential purchaser's point of view, unless they intend to keep Cake trading continuously waiting to see what happens might well be the wisest move.

They likely wouldn't even be buying the Cakewalk Source code. That would just come along as part of the patents and IP.  Sad to say, but I don't expect to see any real new code for Cakewalk SONAR. The only thing I hope for is the unlock key sent to each "owner" of a copy of SONAR. I think it is reasonable to expect that and nothing more.
