sue the wanker.  In Potland the pedestrians and bicyclists have the right of way.  It'd be an open and shut case.  When  I came from the east coast, I couldn't figure out why these folks on bikes were so aggressive, well it turns out they're *empowered*.  :D:D

Get a Lawyer that understands the Law not an ambulance chaser ...
According to the D.O.T. it is against the law to hit people with a vehicle when they are out on a road ...
As an operator of the vehicle you don't get to mow down people that you think that are in your way ...
It doesn't matter if they are walking , running , riding a bike or where they don't belong on the road  ..
You my friend had the right of way the whole time
You were bound as a cyclist to obey the rules of the road ( which I believe you did until you went the wrong way on a one way street  )
Either way , the other person needs to be taught a Lesson ...
Poor impulse control is no excuse for his actions

How would you feel if you lost a limb or if you became paralyzed due to that IDIOT ....

He hit you ...he hit the rear wheel of the bike you were riding..you were in front of him ..you had the right of way
he was clearly at fault ....as far as the mirror go's
"I was afraid for my life I thought this madman was a terrorist trying to perform an act of terrorism using his vehicle" ..."he swung a bat at me and I had to deflect it so I wouldn't have gotten run over by his car " ....
"I did everything I could to find a safe place to get out of his way I couldn't because the street was filled with double parked cars "
Get the officers badge number ..it should be on the report ...it is his job to enforce the law maybe his lazy a$$ might need a reminder ...if you feel he was not attending to you needs you can always file a citizens complaint against the officer ...they will do an investigation and probably try to white wash the whole thing ...
I've been here before bro ...regardless of their finding  the record of your complaint stays in his file 
 
As far a Gunn Foo goes , NYC is not the place for that unless your lifestyle includes having to defend yourself from
being targeted from the criminal element ...C E is not the pussies standing out side the bodega ... I'm talking about the real deal ....
All that aside,  If a NYC police officer catch's you with a cartridge ( the correct name for a bullet ) they will send your a$$ to Riker's

In Canada if you hit somebody from behind you are at fault. IT doesn't matter what you were doing or why it happened, you are expected to remain in control of the vehicle at all times. If you bump into somebody from behind you are guilty of following too closely, going too fast or careless driving. It doesn't matter if the person you hit stopped dead in the road for no reason. You hit, you pay.
 
I would also expect that if you broke his mirror with your hand that you would have some cuts and bruises on that hand. What's the dick going to say, " When I tried to hit him he diverted my swing and I hit the mirror instead." Next time you get chased drive by Trump Tower. Everything will be recorded for ever.

Like Canada, in the UK if you collide with another road user who's in front of you you can expect a hard time explaining how the collision wasn't your fault. After all, you're not supposed to follow vehicles so closely you are unable to stop without hitting them if they do something unexpected. As a lawyer we know puts it, the thing to ask is "if you were paying proper, careful attention to the road conditions and following me at a safe distance, how could this accident possibly have happened?"

If he's a real idiot he'll answer "because I lost my temper with you so chased you down the road waving a baseball bat".

If the driver wants to claim you broke his wing mirror that's something the prosecution will have to prove in court beyond reasonable doubt if it's criminal charges or to the civil burden of proof if he sues. In a criminal trisl, prosecution has to prove your guilt, not the driver, he's just a witness there. By the sounds of it that's a word against word case unless there are disinterested witnesses so is likely to be very difficult to prove. Just keep your cool and don't let them portray you as a very willing participant in some kind of mobile brawl.

As for him hitting you, that seems clearly enough his fault even if you can't prove intent. And like lots of things it boils down to what can be proven in court, which may not be the whole story. You should certainly pursue a civil claim against him for damages, including any physical or psychological consequences as well as recovering any financial loss. His insurer may well cough up money without you nearing to go near a civil court.

Making a claim also formalises what happened. So if there are unforseen consequences in the future, e.g. health wise, you'll have put down a marker now as to what happened and when. Which makes it much easier to claim further damages later than coming to it fresh in several year's time when you might have difficulty proving a collision ever even happened.

As for guns, look on the bright side. The driver either wasn't carrying one or chose not to shoot you.

In court, simply ask the other guy to explain HOW you managed to break his mirror.  




My first thought too.
 
Or tell plod you broke it with your head when he ploughed into you.
