Monster cable would not let it stand and personally I don't think you should... but I could be wrong. I don't know copywrite law and these people have deep pockets, then again deep pockets have lots of cash for paying damages...

Yeah but comcast just has an X1.  Cakewalk has X2 with an X3 on the way.  That's way better than a measly X1.

That would be quite a stretch to argue they are in the same industry.  Without that, there really couldn't be a claim.  How many different businesses have the name "Ace" for example.  If you try to open a hardware store under that name, you will get a call from ACE Hardware's lawyers.  But if you are in the windshield replacement business, ACE hardware has nothing to say about that.
