  • Can I sell Sonar 8.0/8.5 Producer retail box version after X1 purchase

Basically I bought my Sonar 8.0 Producer boxed retail from a authorised dealer nearly 2 years ago. I then got the the free on-site 8.5.3 upgrade soon afterwards, and I have in the last 2 weeks now upgraded to Sonar X1 Producer (again on the Cakewalk site using the option of upgrading from my registered 8.5).
 
Simply, can I now sell my Sonar 8.5 Producer complete with registered Serial and activation code, or is this not allowed. I am struggling to find out the licensing issues on doing this and wherever it is legal for me to do so.

You cannot sell or give away any version of Sonar once you've installed it and accepted the license agreement. You do not own Sonar, you only own a license to use it that is non-transferable. That is the law in the US. The UK may be different.

To be fair. I would think if you uninstall 8.5 and install  a NEW x1, not an upgrade, then you should be able to sell the 8.5.

Absolutely not. Read the End-User License Agreement that you agreed to abide by when you installed the product.

sorry, but that's not correct advice.  yours and the OP's purchase of sonar are final.  you/he agreed to the terms of the EULA when you installed it and it specifically states that you cannot sell it or transfer it.

Oh c'mon... no one reads those EULA's. If they are small print and over 3/4 page long a good lawyer can get it tossed in 10 seconds. I never even glanced at the EULA other than to check the thingy that said I agreed to it... I'll bet 99% of buyers are the same. The only thing those long obtuse EULA's are good for is making money for attorneys.   IMHO

Anyway... I didn't state it as advice, just an idea on how it should be.

Non-transferability of user licences is Cakewalk's policy, but not all software companies are the same.  I sold my copy of Propellerhead Reason 4 last year and the sale was perfectly legitimate.  The buyer is now the registed user and I am no longer registered.  Transferring the licence was easy and straightforward using a facility provided on Propellerhead's website.  Cakewalk could provide this too if they wished and I believe that it would benefit them to do so.

everyone is right. You cannot sell it--please send it to me with serial number info etc.---I am still not an X1 fan. ^_^

You can't give it away either. What part of "non-transferable" don't you get?
