In the case of software I can just see that clogging up the small claims court as customer and vendor battle it out over what a "reasonable" number of bugs is, given that there is no expectation that complicated programs are bug free. I mean does finding a small GUI bug entitle you to a refund? How about a bug that only crops up now and then?

Not even developers can agree what is a bug and what isn't sometimes... A court of law isn't likely to fare better IMHO.
