Just curious Seth.  Is that a direct quote from your legal department?  I'm a complete dumbass when it comes to that sort of thing.  So, folks can't even donate money to Panup?

No, Yorolpal, its not a direct quote. If it was, we'd have an account on here called 'Legal' or something.

We're not stopping anyone from making mods or from you or anyone else using them, just from third-parties making money off of our product without being licensed to do so.

I'm not trying to be a bad guy here, its just how it is.

No...I completely understand, ol pal.  I'm not a lawyer...nor would I want to be one;-)  I just don't want to run afoul of the EULA and I'm sure pannup (he's a really good guy) doesn't either.  Thanks for clarifying.

I get ya, Yorolpal. I'm certainly no lawyer, either. Heck, I seldom watch legal drams on TV or at the movies, so I am by no means an expert at anything legal. However, I do know that's our policy, so its my job to reenforce it when needed.

I'd hate to see anyone break the EULA, too, and I'm not trying to do that. And I'm certainly not suggesting anyone here, especially Panup, is trying to do anything malicious. After all, he's going out of his way to make mods for users like you. Its just that, in the end, mods have to be made and used for free and not for pay.

The best analogy I can give is from the world of video games. Mods are common with games as I've played many myself. However, they are always free for the same reason we require any SONAR mod to be free.

The only exception would be if a game was built off of another game's engine, like how many games are built off of the Unreal Engine. However, in all of those cases, that engine is licensed and costs the developers of said game money to use it.

I'm sorry I mentioned paying for an app like this.  I did not know the details of modification apps.  Please forgive me...I feel like an idiot.

No hard feelings and please don't feel like an idiot. Instead, consider feeling slightly more informed.

Anyways, feel free to getting back to discussing the mod at hand.

If licensing is required couldn't Cakewalk offer to allow Panup's work to be licensed or whatever the correct terminology is.

the license can be limited by whatever conditions cakewalk want but at least allow us to support Panup's efforts.

I mean we support Cakewalks effort by buying our license to use SONAR. That money amasses to an amount big enough to run a whole business. I doubt that panup is going to get rich accepting donations for his efforts but it would be a nice gesture on Cakewalk's part.

Perhaps you could come to a deal with Panup that you could incorporate his code in SONAR - after all when he releases his mods to us we become a huge beta testing group.

Licensing deals are done all the time aren't they. Cakewalk has entered into them before with some of its plugins like with Rene (Gaballos?) I think his name was.

Just some thoughts.

i  think panus work is great..remeber at a time when the release of sonar needed major patching..it was panu who kept users entertained and right here..he lifted alot of the burden from a incomplete product hitting the market.i myself had little to no problems at all.but that doesnt mean i didnt see what was going on around here with the outcry of people not having a working product..pana gave people hope and put some excitment into a product that had a menu set up to change colors but was broken..there i said it..it didnt work..i think cake should let him design some of the gui's..although i do like the look of x1..that battleship grey gets old after a 5-6 hour session.

Well, like Seth and I both said...we're not lawyers:-)  Nor do we play one on TV...but I don't think Cake means to deny any goodwill or even remuneration to Pannup or Ben...just that if there is any it needs to be on the up and up and street legal.  Like Mudgel suggested they might be able to simply reach a licensing agreement.  This seems to have been a win-win proposition for both Cake and the two developers so it wouldn't seem totally out of the question.  It also seems, in this specific case, rather a trivial issue.  What if Pannup had other things for sale on his site that had nothing to do with Cake/Sonar?  What would stop anyone from buying one of those as a "personal thank you" for his work here?  Again, I'm no lawyer, but it would seem that in no way would be an infringement on Roland/Cake etc... Just a thought.  It just seems unfair that both Ben and Pannup cannot be remunerated for all their hard work on this...but they may have to settle for just the goodwill and accolades of the forum members:-)

Sorry, everyone, but modders such as Panup are not allowed to accept money, even as 'donations' for their mods. This is because they are modifying property that is not theirs and do not have the right to redistribute it in any way.

How about this new utility that is 100% my own code? What is the difference between Notepad to edit AUD.INI or regedit to edit SONAR's registry entries and a dedicated utility to access them from one place?

Although no doubt legally that is right, I hope that Cakewalk fully understand that Panu has actually contributed to a lot of X1 users "hanging in there" and continuing to use X1 despite their disappointment about GUI changes. Paunup's thread on color customisation runs to 36 pages or more which is testament to that. I understand that you need to give this general statement above, however, I respectfully hope that Cakewalk continue to indirectly support Panu's efforts by keeping his thread going and not hassling him about any donations that may or may not go his way from any grateful X1 users.

I am saying this just to show support to Panu, and to hope that this doesn't become an issue, especially a legal issue. Just my 2c.

Good thing I donated long before any of this was an issue.

Cakewalk said: 'no donations' for mods. I stopped accepting them.
