I only have a problem with the idea that since they didn't tell us, it is false advertising. No communication("they didn't tell us that") is not false advertising. Where is the lie?

I am speechless. Even though the truth is the truth, there will be nothing gained by explaining the truth here. This person knows the truth but is just looking for a loophole to circumvent it. When you have someone with an agenda, a defense attorney mindset, and ample idle time, you will get nowhere with the truth. There's only a single license for TH2, Rematrix Solo, BReverb, Tone2BiFilter, BlueTubes, etc. etc. I guess these aren't seen as separate products because Cakewalk handles the licensing, but that's really the only difference.

Apparently you missed the heading immediately above the list you quoted. The heading says: Cakewalk SONAR Platinum Features: Every one of the features you listed above is indeed in SONAR Platinum. There is absolutely nothing untruthful about that statement. Furthermore, the catalog description does not say "Upgrade for Plat and Get:" For the record, here are the references to upgrading: NOTE: This is an opportunity for registered users of Cakewalk products to upgrade to a full version of Cakewalk SONAR Platinum from SONAR X3 Producer. Craig you are basing your argument in "implication" and it is "not implied" anyplace in the ad that you don't get 57 FX... By the nature of this ad you are buying an "upgrade", so anything listed as part of the title "upgrade from X3 to plat" with a list of items you get with plat "denotes" any previous agreement regarding X3 and all items associated with X3. there for if it's in the ad they have to give it to you... including new licenses. I have never seen CW say "once you upgrade" you cant use older versions as well. Most likely it was that way to keep customers to work across versions and for me... working with different versions to work around bugs and to have access to old CW plugins that I paid for that don't work in plat. I'm not sorry that I see things as they truly are.... all CW has to do is fix the ad and make it clear.... The problem that I had has been fixed... but I'm going to push this on principle... lol

This has been addressed by a Cakewalk employee here: http://forum.cakewalk.com/FindPost/3166564 Joey Adams [Cakewalk] If you already have a Melodyne Essentials serial number from a prior purchase of SONAR X3 Producer, you should not receive a NEW Melodyne Essentials serial number from a purchase of SONAR Platinum. There are circumstances in which you may have been issued a new serial number due to the way your account was set up at the time of purchase (of either SONAR X3 Producer, SONAR Platinum, or both), but in the vast majority of cases, you should only have one Melodyne Essentials serial number in your SSO account.
I opened a real support ticket asking about it, they responded and also went and posted in the thread it came up in.

Which, with all respect, is why what you're claiming won't go anywhere. A lawyer for any defendant would simply need to show two things to the satisfaction of the judge: 1. That the majority of consumers understand the difference between purchasing an upgrade of a software product vs. a first-time purchase of a software product. 2. That it is unreasonable for a consumer to expect that a product advertised as an "upgrade" would give everything the consumer making a first-time purchase would receive, despite costing 30% of the price. Otherwise, the first time user would simply buy the upgrade, get all the features anyway, and pocket the difference. I believe the judge would grant a summary judgement based on the merits of the case. Whether the judge would require the plaintiff to pay court costs would probably depend on how the judge was feeling that day

I think Dave has been pretty respectful for the most part. Maybe amazingly so since he has been alone for the most part. I think he is "technically" correct on some of this. Something you learn after being married for awhile is, "being right is overrated". Of all the Sonar activity since January no one else has noticed or cares. I know I don't. Another marriage thing is asking myself,"am I willing to die on this hill"? I am not even willing to get a blister on this one.

There is a lot more at play with this really, but to sum up the crux of it => if you purchased an upgrade, you have Melodyne Essential (not were given "another" but that you have it). For people who upgraded from, say X1 producer, they were "made whole" (in fact ALL upgraders are made whole to that list). The licensing behind the scenes was mentioned earlier. There is no verbiage anywhere that says "get another" so any "false advertising" point is moot... you have everything on that list (or should call technical support). I guess I should look into similar against the car companies that never delivered the half-naked babe draped across the hood... I *assumed* I got her too!!!
